$1,000,000      Medical Malpractice   Settlement for the estate of a patient who entered an oral surgery office to have teeth extracted. Complications arose from the sedation, and the necessary steps were not timely taken to resuscitate the patient, resulting in her death. (Kankakee County)

$875,000         Product Liability   Our client suffered a fractured leg requiring surgery and other injuries when a stair climber device intended to allow him to ascend and descend stairs from the in-law apartment in his daughter’s home fell down the stairs while he was strapped into his wheelchair during a training session for his caregiver. Suit alleged that the device was unsuitable for its intended use because the angle of the stairs was in excess of the maximum permitted by manufacturer specifications and that the manufacturer’s representative did not adequately supervise the caregiver during the training session. $855,000         Truck accident Settlement on behalf of disabled school principal who underwent a lumbar fusion after a tractor-trailer sidweswiped him while making a right-hand turn from the left turn exit lane from a parking lot. (Cook County)

$850,000         Car Accident   Settlement for Local 444 ironworker who suffered a injury to his neck which required a cervical fusion operation when a Commonwealth Edison meter reader made a left hand turn in front of him. (Will County)

$830,000         Truck accident   The client was stopped at a red light when the defendant’s truck plowed into the line of stopped vehicles, causing a chain collision. Client struck her knees on the underside of the dashboard, aggravating underlying degenerative conditions in both knees, resulting in first arthroscopic surgery and then replacement of the knees on both sides. Client had extensive prior medical history with regard to both knees, including multiple arthroscopic surgeries. An initial settlement represented exhaustion of the at-fault driver’s policy limits, as there were multiple claims made against the policy. A subsequent underinsured motorist claim made under the client’s own policy paid the balance of the settlement. (Lake County)

$750,000         Car accident Settlement for retiree who suffered a fractured hip requiring a hip replacement when another driver lost control of his vehicle and broadsided the vehicle in which she was a passenger. (Cook County)

$700,000         Construction negligence Settlement for CTA employee who suffered a herniated disc in her neck, requiring a spinal fusion, when contractor employees destabilized a ladder which had to be used to access the job site. (Cook County)

$600,000         Nursing home abuse and neglect   Settlement for nursing home resident who experienced a vascular occlusion in her left leg while on a fall watch. The nursing staff failed to recognize the signs and symptoms of progressive ischemia, resulting in amputation of the leg. (Cook County)

$600,000         Nursing home abuse and neglect   Settlement on behalf of the estate of a nursing home resident who was admitted to the defendant nursing home following a car accident in which he suffered a brain injury. While a resident at the facility, he developed bed sores and was catheterized, leading to a urinary tract infection and a c-diff infection, resulting in the decline of the wound and ultimately death. $600,000         Nursing home abuse and neglect   Settlement on behalf of the estate of a resident who was admitted to the defendant nursing home following brain surgery. The staff failed to ensure adequate intake of fluids despite care plans and policies which required monitoring fluid intake, resulting in kidney failure and skin breakdowns, resulting in the death of the resident. (Cook County)

$600,000         Third Party Liability            Settlement on behalf of a mechanic who was brought into repair a lift plate at the defendant’s warehouse. While on site he was asked to inspect an area at the base of the loading dock without being warned of a rusted-out, mud-covered drain cover which broke underneath his weight. Client suffered a lower back injury which required surgery. Settlement also included a waiver of a significant portion of the worker’s compensation lien. (Will County)

$550,000         Nursing home abuse and neglect   Settlement on behalf of a nursing home resident who suffered multiple fractures in a fall and then additional fractures during rehabilitation. Client had been assessed as a fall risk, but the nursing home staff elected to not perform a fall prevention care plan. (Cook County)

$500,000         Wrongful death   Settlement on behalf of the estate of a two-month old child who died at a licensed home day care when the day care operator placed her on an adult water bed. The child rolled over and suffocated, leaving behind her parents and two brother. Settlement represents the day care center’s insurance policy limits. (McLean County)

$500,000         Medical malpractice   We reached a settlement on behalf of the wife of an active duty sailor who underwent laparoscopic surgery to remove her gall bladder. The suit alleged that the surgeon failed to use proper technique to identify the cystic duct, the only structure which was supposed to clipped an divided during the surgery and instead cut the common bile duct. This necessitated multiple hospital admissions and surgeries. Case settled after the defense expert was confronted with the text if his own book which detailed the technique that was supposed to be employed to identify the cystic duct, and what he recommended in his book was not what the surgeon did. $475,000         Nursing home abuse and neglect   Settlement for case involving two separate incidents involving a geriatric patient with severe mental illness. First incident involved a fall from a wheelchair due to inadequate supervision, resulting in injuries to her cervical spine. Eight days later, she choked to death on food despite the use of a 1:1 sitter. Nursing home was unable to explain what food she choked on or how she obtained it outside of normal meal hours. Staff further failed to recognize that the client was choking, resulting in in effective efforts to resuscitate her. (Cook County)

$400,000         Nursing home abuse and neglect   Settlement for nursing home resident who fell during physical therapy when therapist did not have a fall prevention plan and did not use gait belt, suffering laceration which because infected with MRSA, leading to lengthy hospitalization (DuPage County)

$400,000         Car accident   Settlement for appliance repairman who suffered herniated disc in his lower back, requiring surgery, when other driver crossed over the center line during a snowstorm, resulting in a head-on collision. The settlement was fully paid by the insurer, despite the at-fault driver having policy limits of $100,000. (Cook County)

$400,000         Nursing home abuse and neglect   Settlement for estate of nursing home resident who fell and suffered fractured hip while being assisted from the bathroom by nurse’s aide. The aide violated the care plan and nursing home policy by failing to use a gait belt while assisting the resident.   (DuPage County)

$350,000         Nursing home abuse and neglect   We reached a settlement on behalf of the estate of a nursing home resident who choked to death while being fed by an aide. Nearly two years prior to the choking incident, the resident (who suffered form Parkinson’s) underwent an assessment by a speech therapist who identified various problems in her ability to chew and made recommendations to help assure her safety. Those recommendations were never incorporated into her care plan, nor was she returned for a repeat assessment despite the progressive nature of the disease. Suit further alleged that the staff failed to recognize that she was choking and suction the airway. (DuPage County)

$320,000         Nursing home abuse and neglect   We reached a settlement on behalf of the estate of a nursing home resident who developed pressure sores after he was switched from a standard wheelchair to a Tilt in Space wheelchair. Before the switch, he was able to self propel in his wheelchair, but could not in the Tilt in Space, and his efforts to do so exposed his buttocks to friction and shear, resulting in deep tissue injuries which required surgery. Suit alleged that the Tilt in Space wheelchair acted as a restraint for which there no consent or physician order and that the staff failed to recognize that the resident was being exposed to friction and shear in his efforts to self-propel in the Tilt in Space chair.

$320,000         Construction accident     Settlement in favor of a carpenter who suffered a ruptured ACL and torn cartilage when he stepped in a hole on a job site, requiring surgery. Suit against the property owner alleged that they failed to inspect the property and fill the hole. (LaSalle County)

$310,000         Nursing home abuse and neglect   Settlement was reached in behalf of the estate of a nursing home resident who choked on a hot dog while being fed lunch. Suit alleged that the speech therapist failed to provide appropriate dietary restrictions when she was transitioned from a puree diet to a general diet and that the staff failed to cut the hot dog up into small enough pieces as a paramedic testified that he removed a three-inch long piece of hot dog from the client’s airway. (Macoupin County)

$290,000         Car Accident   Client was rear-ended while waiting to make a left turn. Client had a history of lower back surgery and had unoperated herniated discs in his neck, but the trauma from the accident aggravated the underlying condition in his neck and required a fusion operation. Case settled after the defense expert agreed that the trauma from the motor vehicle accident aggravated the underlying degenerative conditions and necessitated the surgery. (Cook County)

$275,000         Medical malpractice   We reached a settlement on behalf of the estate of a retiree who suffered from COPD and was brought to the emergency room after he refused to use his supplemental oxygen. When he was told in the emergency room that he was going to be admitted to the hospital, he became agitated and had to be sedated with Ativan. After being admitted to telemetry unit, the nurse on the floor elected to not use a bed alarm on him because he was compliant with her instructions. She was unaware of his recent history of noncompliance with care instructions and that he had been sedated with Ativan before being brought to the unit. He got up to go to the bathroom without assistance contrary to instructions and fell, suffering a fractured hip. He suffered a post-operative heart attack which ultimately led to his death. $250,000         Nursing Home Abuse and Neglect   We reached a settlement on behalf of the estate of a retired security guard who was admitted to the nursing home for rehabilitation after undergoing surgery to remove an abcess from his jaw. The resident was a fall risk due to weakness and disorientation from the infection. The staff promised the family that a bed alarm would be used that night. However, they could not find a working alarm in the facility. After his first night in the nursing home, he attempted to go to the bathroom by himself and fell, causing a brain bleed which resulted in s death the following day. (Macon County)

$250,000         Nursing Home Abuse and Neglect   We reached a settlement on behalf of the estate of a nursing home resident who fell while being left unattended on a commode chair while she was being admitted to the defendant nursing home for rehabilitation after fracturing a hip in a fall at home. The fall from the commode chair resulted in the other hip being fractured. After undergoing surgery, she was sent home on hospice care and died 11 days later (Winnebago County)

$250,000         Nursing Home Abuse and Neglect We reached a settlement on behalf of a nursing home resident who was admitted to the defendant nursing home from the community and was placed in the shelter care unit where fall risk assessments and fall prevention care planning was not done, nor was it required by state regulations. She fell her third night in the facility, suffering a fractured hip and shoulder. Surgery was performed on the fractured hip but she suffered a post-operative stroke, resulting in her death ten days after the fall. Suit alleged that the admissions staff failed to appropriately assess her care needs and had a proper assessment been performed, she would have been admitted to the skilled care unit where fall risk assessments and fall prevention care planning would have been required. $240,000         Motor vehicle accident   We reached settlement on behalf of the estate of a truck driver who was killed when he was struck by a taxi while crossing Cicero Avenue mid-block at night near Midway airport. We were able to reach a settlement in this matter despite the client’s very high blood-alcohol content because our investigation revealed two independent witnesses who testified that the cab was speeding immediately before striking our client. $225,000         Premises liability   We reached a settlement on behalf of a real estate agent who tripped on a piece of conduit in the parking lot for her agency. The conduit powered the electric sign for the agency. She suffered injuries to her shoulder and knee which required surgery. We obtained testimony from multiple agents that they had also tripped on the conduit prior to the client’s injury. (Cook County)

$225,000         Premises Liability    Settlement in favor of a pedestrian who was caused to fall on a sidewalk defect outside the Kankakee Post Office, aggravating a prior low back injury. (Kankakee County)

$205,000         Car accident Settlement in favor of client who was injured when a student pulled out of a school parking lot in front of him. The student was driving a pick-up owned by his father’s business, allowing us to reach the commercial policy for the business. Client suffered a herniated disc in his neck, but opted to not have surgery. (Cook County)

$200,000          Nursing Home Abuse and Neglect  Settlement in favor a the estate of a nursing home resident who was suffered a fractured hip in a fall.  Despite being assessed as a fall risk for reasons which included musculosketeal weakness and impulsive behaviors, her care plan did not include the use a bed alarm.  She fell while getting out of bed unattended.  At two previous nursing homes, bed alarms were used as part of the fall prevention care plan.  Client underwent surgery to repair the hip fracture.  Died five months later due to unrelated causes.  (Cook County)

$195,000         Car accident   Settlement in favor of client who was broadsided by another vehicle which was emerging from a parking lot. Impact caused client to lose control of her vehicle, hitting two other stopped vehicle and a light pole. Client underwent arthroscopic knee surgery for torn cartilage in the knee. (Cook County).

$195,000         Nursing Home Abuse and Neglect We reached a settlement on behalf of a nursing home resident with advanced Alzheimer’s. She was largely wheelchair bound, but would try to get up and walk without assistance early in the day, so her care plan included leaving her near the nurse’s station before breakfast. On the day of the accident, she was dressed and brought out to the nurse’s station, but got up and walked unattended all the way down the hallway to her room where she fell and suffered a fractured hip. $192,500         Nursing Home Abuse and Neglect We reached a settlement on behalf of a nursing home resident who fell and suffered a fractured hip. The client suffered advanced dementia and frequently tried to get up unattended. The staff was well aware that she was a fall risk and charted that she needed to be watched closely due to her inability to follow instructions to not get up without help. Further, there was a physician order for there to be a bed alarm and chair alarm in use and checked every shift. She was left unattended in the dining room at 2:00 a.m. and got up and walked down the hall without assistance before she fell. Inspection of her wheelchair showed that the alarm was not working at the time of her injury. (Cook County)

$187,542         Car Accident We reached a settlement on behalf of a municipal employee who was involved in a car accident in which the other driver ran a stop sign causing the client to suffer a fractured wrist which required a fusion. Settlement represented the policy limits from the at-fault driver and the balance of the underinsured motorist coverage available after deducting credits for worker’s compensation benefits. $185,000         Nursing home abuse and neglect   Client was admitted to the nursing home for rehabilitation following a hip fracture from a fall at home. The nursing home staff failed to respond to the call light, resulting in the client falling and suffering a fracture to her other hip. (Cook County)

$175,000         Premises liability   We reached a settlement on behalf of our client who suffered injuries to his knee and shoulder which required arthroscopic surgery after being injured when a porch deck collapsed at his uncle’s home during a family party. The settlement represents over half of the available insurance coverage despite multiple other claims being made against the insurance policy by other people who were on the deck at the time of its collapse. $175,000         Trucking Accident We reached a settlement on behalf of a passenger in a vehicle which attempted to pass a line of four trucks on a two lane country road. As they attempted to pass the third truck, it moved into the passing lane to drive around the lead truck in the line which was slowing to turn into a country lane. The driver of the client’s vehicle lost control of the car which went airborne and rolled several times, resulting in multiple fractures to the client. Case settled as the driver of the third vehicle admitted that he knew that the truck ahead of him was going to slow to turn into the drive and did not maintain an adequate stopping distance ahead of him and chose to enter into the passing lane knowing that the client’s vehicle was present there.   (Jasper County)

$165,000         Medical malpractice Verdict in favor of diabetic patient who suffered laceration to foot during diabetic foot care, resulting in infection which required removal of great toe joint. (Cook County)

$165,000         Premises Liability   We reached a settlement on behalf of a nurse who suffered a fractured ankle which required surgery when slipped on ice while walking on a public sidewalk with her husband. Our investigation revealed that the downspout from the neighboring condominium building drained water down a hill and onto the sidewalk, causing the patch of ice on which she slipped and fell. $160,000         Nursing home abuse and neglect   Client was admitted to the nursing home after falling at home and fracturing her hip. She was assessed as a fall risk due to balance issues and intermittent confusion coupled with poor safety judgment, so a clip-style alarm was applied. Client repeatedly removed the alarm, but staff continued to use the clip style alarm instead of using a pressure-sensitive alarm. Client suffered a fracture to her other hip when she removed the alarm and got out of bed and fell. Case settled following the deposition of the defense expert who conceded that with the history of the client removing the clip-style alarm, a pressure-sensitive alarm should have been deployed. $160,000         Bus accident   Settlement for bus passenger who suffered lower back injuries when bus driver stopped and started bus in violation of CTA internal policies, resulting in fall and injury to passenger who had just boarded bus, but had not yet reached seat. (Cook County)

$152,000         Car Accident   Arbitration award in an underinsured motorist claim brought on behalf of a police officer who was rear-ended on I-294 while on his way to work, suffering shoulder injuries which required surgery. Settlement was reached in the underlying case after the deposition of the defendant’s own expert who conceded that the injuries were caused by the car accident and that the trauma from the motor vehicle accident necessitated the care received by the client. The underinsured motorist carrier hired a second expert who claimed that that there was no injury at all – a proposition that was rejected by the arbitrators. (Cook County)

$150,000         Car Accident Arbitration award in favor of technician who was visiting Chicago from California for a trade show. While traveling from McCormick Place to his hotel, his vehicle was rear-ended, resulting in lower back injuries for which surgery was recommended but was never performed. (Cook County)

Client was admitted to the nursing home following a hip replacement surgery which was complicated by a post-operative heart attack. Defendant attempted to place blame for the sores on the hospital. $120,000         Dog Bite         Settlement reached for a woman who was bitten in the hand by her brother-in-law’s dog when the dog tried to snatch food out of her hand at a party. Client suffered a fractured finger which required surgery. (Cook County)

In going down a particularly steep berm, he bottomed out the ATV, bringing it to an abrupt halt and causing the client to suffer a fractured humerus that required surgery. $75,000           Premises Liability    Settlement reached on behalf of a mother who was walking from her car to the sidewalk when she stepped into a hole and fell, suffering a broken wrist.
